Barbara:

Please find the attached Location Exception letter for the wells closer than 600' to a lease line on the Whittaker Flats D17 998 pad.  Also, see the below email from Bob Hartman at the BLM regarding this location.    This should allow you to continue to process the permits on this pad.

Please let me know if you need anything further.

Thanks,

Miss Heather and COGCC

After reviewing the submitted APDs and our lease data I see no issues with continuing forward with the APD approvals from the Federal side.

COGCC can use this email as an OK for the setback being less than 600’ for the wells you have listed below.

The BLM will not approve the APDs until the proposed unit is approved and we firm up the proposed BHLs.

If there are any questions please get back to me.

Thanks

Bob:

In order for the State to process our permits on the WhF D17 998 pad, they need the BLM to approve the placement of our bottom holes. The BHLs are less than 600 feet away from the adjacent lease to the South COC66211.   Encana has rights to this BLM lease.    Four of our six wells are closer to this lease than the State allows without an exception letter and a waiver from the BLM.   Encana has proposed a unit (also attached) that will eliminate the issue with the setbacks upon its approval, however the State will not continue to process without a waiver from the BLM.   An email with your approval will suffice.

The  following wells are are all less than 600 away from the COC 66211 BLM mineral lease and I have attached our multiwell plan for your reference.

DHS1C-19 D17 998

DHS7C-20 D17 998

DHS5C-20 D17 998

DHS3C-20 D17 998 .

Please let me know if you have any questions or concerns.

Thank you!
